Terms and conditions

1. The agreement

These terms form an agreement between you and the operator of Phishing Protect ("we", "us"). "The extension" means the Phishing Protect browser extension in any of its builds. "The site" means this website. If you do not accept these terms, do not install the extension and do not use the site.

2. Licence to use

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the extension on devices you control, for personal or business purposes, free of charge unless you have separately purchased a branded build under section 9.

This is a licence, not a sale. We keep all rights not expressly granted here.

3. What you may not do

• Redistribute a modified copy of the extension under the Phishing Protect name, or in a way that suggests we published it.
• Sell, sublicense or rent access to the extension.
• Remove or obscure copyright or attribution notices.
• Use the extension to interfere with, disrupt or gain unauthorised access to any system.
• Use the extension, or claims about it, to mislead anyone about the security of a website.
• Use it in any way that breaks the law where you are.

4. Nature of the service

This section matters more than the rest, so it is written plainly.

The extension is a warning tool, not a guarantee of safety. It compares the address of a page against a list you supply. It cannot determine whether a website is trustworthy, whether its operator is honest, or whether your data is safe there.

In particular:

• A phishing site that does not resemble any domain on your list will not be flagged.
• An absence of warning is not a statement that a site is legitimate.
• Legitimate sites are sometimes flagged, because resemblance is not proof of intent.
• Attack techniques change, and detection rules will always trail behind some of them.
• The extension does not protect against malware, compromised legitimate sites, intercepted traffic, credential reuse or social engineering conducted anywhere other than in a web address.

Keep using strong unique passwords, a password manager and two-factor authentication. Nothing here replaces them.

5. Your responsibilities

• The extension only protects domains you enter. Entering them accurately, and keeping the list current, is your job.
• If you allow a domain after dismissing a warning, that domain stops being checked until you revoke it.
• Decisions about whether to trust, sign in to or transact with a website remain yours.
• You are responsible for keeping your browser and operating system updated.

6. Availability and updates

We may update, change or discontinue the extension or any of its features at any time. Updates are delivered by your browser's add-on store and may install automatically depending on your browser settings. We do not promise that the extension will be free of errors, or that it will remain compatible with every browser version.

7. Distribution platforms

The extension is distributed through Mozilla Add-ons and the Chrome Web Store. Your use of those platforms is also governed by their terms, and they may remove, suspend or restrict any extension at their discretion, including this one. We have no control over that.

8. Intellectual property

The extension, this site, the Phishing Protect name and the associated logo and design are owned by us or our licensors and protected by copyright and trade mark law. Nothing in these terms transfers ownership to you. Third-party names, browser names and domain names appearing on this site belong to their respective owners and are used descriptively; example domains are fictitious.

9. Paid and branded builds

We offer custom builds carrying an organisation's own name, icon and preloaded domain list. Those are supplied under a separate written agreement covering scope, fees, support and delivery. Where that agreement conflicts with these terms, that agreement prevails for the build it covers. Unless it says otherwise, fees are payable in advance and are not refundable once a build has been delivered.

10. Disclaimer of warranties

To the maximum extent permitted by law, and subject to section 11, the extension and the site are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, security or non-infringement. We do not warrant that the extension will detect any particular threat, or that it will operate without interruption or error.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a statutory guarantee applies and we are permitted to limit our liability for breaching it, our liability is limited, at our option, to supplying the extension again or paying the cost of having it supplied again. Consumers elsewhere keep any equivalent non-excludable rights under their own local law.

12. Limitation of liability

To the maximum extent permitted by law, and subject to section 11, we are not liable for any indirect, incidental, special, consequential or exemplary loss, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or connected with the extension or the site — including any loss resulting from a phishing site the extension did not flag, or from a legitimate site it did flag.

Our total aggregate liability arising out of or connected with these terms is limited to the greater of the amount you paid us for the extension in the twelve months before the claim, or AUD $100.

13. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the extension, or your use of it in a way that infringes another person's rights.

14. Termination

You may end this agreement at any time by uninstalling the extension. We may suspend or end your licence if you breach these terms. Sections 8, 10, 11, 12, 13 and 15 survive termination.

15. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. If you are a consumer in another country, this does not deprive you of the protection of mandatory laws that apply where you live.

If any provision of these terms is found unenforceable, it is severed and the rest continues to apply.

16. Changes to these terms

We may revise these terms. The version number and effective date at the top of the page change when we do. Continuing to use the extension or the site after a revision means you accept the revised terms; if you don't accept them, uninstall the extension.
